These Terms & Conditions (“Terms”) govern your use of the website, booking services, and charters operated by Hawaii Catamaran Charters (“Company,” “we,” “us,” or “our”). By booking, boarding, or otherwise using our services, you agree to these Terms. If you do not agree, do not book or board.

1. Definitions

“Guest,” “you,” or “your” means any person who books, purchases, or participates in a charter or activity provided by the Company.
“Charter,” “Trip,” or “Cruise” means any vessel rental, excursion, tour, or related service provided by the Company.
“Booking” or “Reservation” means a confirmed paid or deposit-secured booking for a Charter.

2. Acceptance of Terms and Changes

We may update these Terms at any time. Updated Terms take effect when posted on the Website. It is your responsibility to review the Terms prior to booking. Bookings made after a change are subject to the updated Terms.

3. Bookings, Deposits, and Payments

A booking is confirmed only when we have received payment or the required deposit and issued a confirmation. A non-refundable deposit may be required to secure a reservation, and the amount will be disclosed at the time of booking. Any remaining balance is due by the deadline stated in your booking confirmation, commonly 14 to 30 days prior to the charter. Failure to pay the balance by the deadline may result in cancellation and forfeiture of the deposit. Accepted payment methods will be disclosed during booking. All payments are processed in U.S. dollars. We reserve the right to correct pricing or typographical errors.

4. Pricing, Fees, and Taxes

Quoted prices may not include taxes, port fees, fuel surcharges, gratuities, or optional extras. Any additional charges will be disclosed at booking or on your invoice. Additional fees may apply for special requests, extended charter time, or damages.

5. Cancellation and Refund Policy

Specific cancellation terms will be provided in your booking confirmation and control in the event of a conflict. In general, cancellations made more than 30 days prior to the charter may receive a refund less any non-refundable deposit. Cancellations 15 to 30 days prior may receive a partial refund. Cancellations within 15 days of the charter, no-shows, or late cancellations are typically non-refundable. If the Company cancels a charter for operational, weather, or safety reasons, we will offer a full refund or the option to reschedule. Weather and safety-related cancellations are addressed in Section 11.

6. Changes and Modifications by Guests

Requests to change dates, times, or passenger counts are subject to availability and may incur fees. Changes requested after final payment deadlines may be treated as cancellations and rebookings.

7. Check-In, Boarding, and Identification

Guests must arrive at the designated meeting location by the time stated in the booking confirmation, typically 30 to 60 minutes before departure. Government-issued photo identification may be required. The Company reserves the right to refuse boarding to guests who arrive late, appear intoxicated, are unfit for travel, or fail to provide required documentation.

8. Health, Fitness, and Accessibility

Guests must disclose any medical condition, disability, or mobility limitation that could affect safety or participation. By booking, you confirm that you are physically able to participate. Certain activities may require medical clearance. The Company is not responsible for medical conditions arising during a charter, and any medical evacuation or treatment costs are the guest’s responsibility.

9. Safety and Conduct

Guests must follow all crew instructions and safety rules. Safety equipment provided by the Company must be used as directed. Illegal drugs, weapons, and hazardous items are prohibited. Guests who engage in unsafe, disruptive, or intoxicated behavior may be denied boarding or removed from the vessel without refund and at their own expense.

10. Minors

Minors must be accompanied by a parent or legal guardian unless expressly permitted otherwise. Parents and guardians are responsible for the supervision and conduct of minors.

11. Weather, Route Changes, and Force Majeure

Weather, sea conditions, government orders, or safety considerations may require itinerary changes, early returns, or cancellations. We will make reasonable efforts to notify guests and offer rescheduling or refunds when appropriate. Events beyond our control, including acts of God, severe weather, strikes, pandemics, or governmental actions, may excuse performance, with liability limited to refunding amounts paid for affected services or offering alternative dates.

12. Personal Property

Guests are responsible for their personal belongings. The Company is not liable for loss, theft, or damage to personal property unless caused by gross negligence. Items left on board may be held for a limited time, and return shipping costs may apply.

13. Photography and Media

By boarding, you grant the Company a non-exclusive, worldwide, royalty-free license to use photographs or video recordings taken during the charter for marketing and promotional purposes unless you notify us in writing before the charter.

14. Limitation of Liability

To the maximum extent permitted by law, the Company and its affiliates are not liable for indirect, incidental, consequential, or punitive damages. The Company’s total liability for any claim shall not exceed the amount paid by the guest for the affected charter.

15. Release and Indemnification

You release and agree to hold harmless the Company and its representatives from claims arising out of participation in a charter, to the fullest extent permitted by law. You agree to indemnify the Company for claims or losses resulting from your actions or breach of these Terms.

16. Insurance

The Company maintains required commercial and vessel insurance. Guests are encouraged to obtain travel, medical, and personal property insurance.

17. Intellectual Property

All content on the Website, including text, images, and trademarks, is owned or licensed by the Company and may not be used without written permission.

18. Third-Party Services

The Company may engage third-party providers. We are not responsible for the acts or omissions of third parties. Links to external websites are provided for convenience only.

19. Privacy

Use of the Website and services is subject to our Privacy Policy, which governs how personal information is collected and used.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Hawaii. Any dispute arising from these Terms shall be brought in the state or federal courts located in Hawaii, unless otherwise required by law.

21. Severability, Waiver, and Assignment

If any provision is deemed unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. Guests may not assign bookings without prior written consent. The Company may assign its rights and obligations.
